The delivery of legal documents to defendants involved in a case is their most critical job. After service of legal documents, the servers are legally required to present solid evidence that the papers were actually served.

The evidence of service of documents that is presented is referred to as an affidavit or proof of service. This must be notarized and handed to the person or firm who asked for the documents to be served. Court servers are obligated by law to serve documents in the right way as provided by their state. Service of legal papers is essential for a number of reasons, but the most essential reason is to ensure that procedural law is followed in the country. Another reason why servers play a major role in the civil society is since they ensure that court documents are properly served. If documents fail to be served in the right manner, the court cannot make a decision on a case involving an individual if he was not informed of it in a legal way.

If service is deemed insufficient, the whole case could be dismissed. This makes it very vital for servers to be aware of the laws of the state concerning the proper way to legally serve a defendant. Servers should be fully aware of all the laws that are applied when effecting service on a defendant. It is important to note that servers are individuals who possess training in law, therefore they can be held liable for negligence if they fail to effect the service properly.
